I am coming back to you because I am a DPO for several companies and I have a legal question on the data confidentiality
My question is simple: When a website does not activate ANY tracking cookie agents, should the cookie banner be activated or not ?
Why this question?
because…
1- when I check my client’s page for which we see that no tracking cookie is activated
2- that I go to the page in question and that I click on the padlock to display the cookies. I see more than 10 in operation! (10 enabled by default? That’s huge)
3- I see that the wix cookies are well connected (by default) to this website
4- and that despite the fact that I did not request a tracking cookie. Wix provides me with visitor information
So I just want to be sure that my clients’ websites are GDPR compliant.
And that the ONLY cookies from wix are indeed functional cookies and not tracking cookies. (otherwise it would mean that this banner would have to be activated by default)

FYI: Moreover in France, (that for u @stana ) the CNIL asked a few days ago that the cookie banner can have the box “refuse” which is not the case of the cookie banner of wix
The Cnil indicated on its website (Cookies et autres traceurs : la CNIL publie des lignes directrices modificatives et sa recommandation | CNIL) that operators have six months to comply with these new rules, i.e. until the end of March 2021
